Terms of service

These terms are between you and Nabour Labs Inc. (“Nabour Labs,” “we,” “us”), a corporation incorporated and registered under the laws of the Province of Ontario, Canada, and govern your access to and use of Optigram.
Acceptance
By installing, connecting a Telegram bot to, or otherwise using Optigram, you agree to these terms on behalf of yourself and the business or agency you represent. If you don't have the authority to bind that business, don't install the app. You must be able to form a binding contract to use Optigram. Optigram is a business tool for GoHighLevel agencies and their teams; it is not offered to consumers.
The service
Optigram registers Telegram as a custom conversation channel inside GoHighLevel. You install it per sub-account from the Marketplace, connect your own Telegram bot, and generate opt-in links so leads can start the conversation. Billing is the Marketplace subscription you configure for the location; agencies may rebill their clients.
No cold outreach
Telegram bots cannot start chats with users who have not messaged the bot. You must not use Optigram
to scrape, import, or mass-message Telegram users who have not opted in. Outbound to a contact without
an active mapping fails with no_telegram_optin rather than sending.
Your responsibilities
- Comply with Telegram Bot API terms, GoHighLevel terms, and applicable messaging and privacy law.
- Keep BotFather tokens secret; each location uses its own bot.
- Obtain whatever consent your jurisdiction and your client agreements require before collecting Telegram identities.
- Do not send content through the channel that Telegram or GHL prohibit.
You (the location owner or agency) are solely responsible for consent, messaging and privacy law, and all content sent or collected through the channel. These terms and the privacy policy are not legal advice.
Prohibited uses
- No content or use that violates Telegram's terms, the Bot API rules, or GoHighLevel's terms.
- No transmitting protected health information, payment card data, or other specially regulated data through the channel — Optigram is not built or certified as HIPAA- or PCI-compliant infrastructure.
- No unlawful, harassing, fraudulent, or infringing content, and no use that violates a third party's rights.
Third-party platforms
Optigram depends on Telegram, GoHighLevel, and Amazon Web Services, which are independent of Nabour Labs. We do not control their uptime, APIs, policies, or terms, and we are not liable for their acts, omissions, outages, or changes. Your use of those platforms is governed by their own terms.
Intellectual property
Nabour Labs owns Optigram, including its software, branding, and documentation. Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to use the hosted service while your subscription is active. You retain ownership of your own contact data and messages; you grant us the license needed to process that data solely to operate the service for you.
Availability and limits
Outbound is rate-limited (~30 messages/second per bot, ~1/second per chat). Media is text-first in the current product; some inbound media is a placeholder. We do not guarantee uptime, delivery, or message success. We do not offer service credits unless a separate written agreement says otherwise.
Support
If you email support@optigram.app from an address we can associate with your install, we will send a first human response within 24 hours. That first-response time is our only service-level commitment. A missed response time does not create extra damages or credits; the exclusive remedy is that we still respond, and any claim remains subject to the limitation of liability below. Details: Support.
Suspension and termination
We may suspend or terminate your access to Optigram if you violate these terms — including the no-cold-outreach rule — or if suspension is required by Telegram, GoHighLevel, or applicable law. You may stop using Optigram at any time by uninstalling it from GoHighLevel. Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability, indemnification, and governing law — continue to apply after termination.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPTIGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We are not a telecommunications carrier. We do not guarantee that the service will be uninterrupted or error-free, or that Telegram or GoHighLevel will remain available or unchanged. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. This page and the privacy policy are not legal advice and do not certify HIPAA or any other regulated-industry framework. The privacy policy describes how we process data; it does not create extra warranties.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NABOUR LABS INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF OPTIGRAM, UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, OR STATUTE), EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO OPTIGRAM IS LIMITED TO THE AMOUNTS YOU ACTUALLY PAID TO NABOUR LABS INC. FOR OPTIGRAM IN THE 12 MONTHS IMMEDIATELY BEFORE THE CLAIM AROSE, EXCLUDING AMOUNTS PAID TO GOHIGHLEVEL, TELEGRAM, OR OTHER THIRD PARTIES. IF YOU PAID NABOUR LABS INC. NOTHING IN THAT PERIOD, THAT CAP IS ZERO.
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence where that liability cannot be excluded.
Indemnification
You agree to indemnify, defend, and hold Nabour Labs Inc. harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from or relating to your use of Optigram, your content, your violation of these terms, your violation of applicable law (including messaging and privacy law) or of Telegram's or GoHighLevel's terms, or third-party claims arising from your messaging or opt-in practices.
Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. You agree that any dispute arising from these terms or Optigram will be brought exclusively in the courts located in Ontario, Canada, and you consent to that jurisdiction and venue.
Changes to these terms
We may update these terms from time to time; the “Last updated” date above reflects the most recent revision. Continuing to use Optigram after a change takes effect means you accept the updated terms.
General
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. We are not liable for delays or failures caused by events outside our reasonable control. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the privacy policy, are the entire agreement between you and us regarding Optigram. The privacy policy is informational and does not create extra warranties; support response time is stated in these terms and on the support page.
